As the exclusive licensee of the Tursian brand, we retain all associated intellectual property rights. Our registered office is located at DSO Operations Centre, Block A Unit 101-1, Dubai Silicon Oasis, Dubai, United Arab Emirates, and we are registered as a Free Zone Establishment with limited liability under the Dubai Integrated Economic Zones Authority (Registration Number: DSO-FZE-12623). These Conditions apply exclusively to natural persons acting outside the scope of trade, business, craft, or profession.

Price
3.1 Pricing of Goods: The price of the Goods displayed on our website at the time of your order will be the price you are charged. Prices are shown in US Dollars (USD), Canadian Dollars (CAD), Euros (EUR), British Pounds (GBP) and Australian Dollars (AUD), include applicable local taxes.
3.2 Import Duties and Local Taxes: Please note that additional import duties, taxes, or fees may apply in some countries. Prices displayed on the Website do not include these destination-specific charges. If your destination is a DAP (Delivery at Place) country, you, as the recipient, are responsible for paying all import duties, customs fees, and local taxes required to clear your order from customs upon arrival. We cannot estimate these charges, as they are determined by local authorities.
3.3 Pricing Errors: If an error occurs and you are charged more than the actual price of the Goods, we will notify you promptly. You will have the option to reconfirm your order at the correct price or cancel the order. If you choose to cancel, we will issue a full refund or re-credit your account.

Liability
6.1 Compliance and Quality Guarantee: We guarantee that the Goods offered on the Website adhere to relevant laws and standards, are of acceptable quality and quantity, suitable for their intended use, and align with the key features described on the Website.
6.2 Warranty Provisions: The Goods automatically come with the following assurances at no additional cost, separate from any withdrawal rights:

Conformity Assurance: Applies to Goods that are faulty, damaged, stained, or do not align with the order, for a duration of 30 days from the delivery date.

Hidden Defect Coverage: Protects against defects caused by materials, design, or manufacturing faults that make the Goods unsuitable for use, for a period starting from the date the defect is identified up to the product's expiry date.
6.3 Procedure for Claims: To utilize your warranty rights, follow the steps outlined in Section 7. Warranty remedies are restricted to either replacing or refunding defective.
6.4 Liability Limitations: We are not responsible for:

Violations of laws in the country where the Goods are delivered.

Improper use, professional usage, negligence, or lack of proper care by the buyer.

Delivery issues arise from incorrect or outdated address details provided by you.

Interruptions or delays in service due to maintenance, security, or technical reasons.

Situations deemed as force majeure by local courts.
6.5 Non-Excludable Liabilities: We remain fully responsible for:

Warranty
7.1 Your Rights When Purchasing Goods from Our Website:

If the Goods are defective, damaged, soiled, lost in transit, or do not match the order, you can request either a replacement or a full refund, including any re-delivery costs.

If you would prefer a different item, you may exchange the Goods you received.
7.2 How to Return Goods:
You must contact us within 45 calendar days of the delivery or collection date to claim your rights. Provide your order number, details of the Goods, delivery information, and any relevant defects.
If you wish to exercise your withdrawal right, contact us through Support@tursian.com and return it to us either online or by post, as indicated in the initial part of these terms.
7.3 Returning Defective Goods:
For Goods that are defective, or damaged, we will provide prepaid return labels through the delivery channel. If you do not allow the Delivery channel to collect the Goods within a reasonable time after informing us of your intention to withdraw, we may charge you for the cost of retrieving the Goods.
In cases of exchanges or returns due to a change of mind, you are responsible for selecting the courier and covering the return shipping costs. We recommend using a tracked shipping service and keeping proof of return.
Returns and exchanges are not allowed at stores or retailers.
7.4 Conditions for Returning Goods:
Goods returned must be in their original condition, including all packaging, labels, notices, protective covers, and boxes. Specifically, the crystal film covering the box must remain unbroken, and the original invoice should be included.
7.5 Refund or Exchange Process:
Once we receive the Goods in satisfactory condition, we will process your refund or exchange, based on your preference, within 14 days.
Refunds or exchanges cannot be processed until we have received the returned Goods.
Goods that are incomplete, damaged, or soiled upon return will not be eligible for a refund or exchange.
7.6 Exchange Procedure:
When Goods are exchanged, the original sale is canceled. The payment for the new transaction will be offset by the original sale amount. Any remaining balance will be refunded, and any additional charges will be processed through your selected payment method.
Goods obtained through an exchange are not eligible for further exchange.

8.1 The content of the Website, including the TURSIANTM trademark and all associated trademarks, whether graphic or not, along with all other symbols, illustrations, images, and logos featured on our products, accessories, or packaging—whether registered or not—remain the sole and exclusive property of Tursian or any related entity, as specified herein.
8.2 Any reproduction, in whole or in part, alteration, or use of any part of this content, trademarks, images, logos, or illustrations, for any purpose and by any means, is strictly prohibited without our prior written consent. This includes any combination or usage alongside other marks, symbols, logos, or any other distinguishing features intended to create a composite logo. Such actions may be considered a violation of intellectual property rights and could lead to legal actions for counterfeiting.

By placing an order on the Website, you acknowledge and consent to the collection, use, and transfer of your personal information in accordance with the terms outlined in the Privacy Policy (link).

Governing Law
10.1 The terms of this Contract and any disputes or claims that arise in connection with it, including those relating to its formation or subject matter (even those that are non-contractual), will be governed by and interpreted under US law. This is subject to any mandatory legal provisions of your home country’s law that may apply.
10.2 Any disputes relating to these Terms will be resolved in the competent courts of your country of residence. However, please be aware that you have the option to resolve disputes with us through mediation, using the services of your local Consumer Commission or any other alternative dispute resolution method available.
